By Editorial Team
AbbVie Inc. has reached a settlement in litigation with several drug manufacturers, effectively preventing generic versions of its immunosuppressant Rinvoq drug from entering the market until 2037. This settlement concludes the legal battle that accused generic-drug makers of infringing on AbbVie’s patents.
The settlement terms ensure that AbbVie retains exclusive rights to Rinvoq for just over a decade, providing the company with a significant competitive advantage in the pharmaceutical market.
The litigation involved multiple parties, including drug manufacturers such as Aurobindo Pharma Ltd., Hetero Labs Ltd., Intas Pharmaceuticals Ltd., Sandoz International GmbH, and Sun Pharmaceutical Industries Ltd. The legal dispute was heard in the U.S. District Court for the District of Delaware.
Key law firms involved in the litigation included Covington & Burling, Latham & Watkins, Morris James, and Morris Nichols. The case was presided over by Judge Maryellen Noreika.
This settlement marks a significant development in the pharmaceutical industry, impacting the availability of generic versions of Rinvoq and reinforcing AbbVie’s position in the market.
