UN Experts Condemn Peru’s Dismissal of Judge, Warn of Threat to Judicial Independence

The controversy comes at a time when Peru has been facing ongoing political instability, with frequent clashes between government bodies and judicial authorities. Observers note that tensions between branches of government have increasingly spilled into the legal sphere, placing judges under heightened scrutiny and, in some cases, pressure. The dismissal of a judge seen as independent has intensified these concerns.

UN human rights specialists emphasized that judicial independence is a cornerstone of democracy and must be protected at all costs. They called on Peruvian authorities to ensure that disciplinary measures against judges are conducted transparently, fairly, and in accordance with international standards. Any perception that judges are being punished for their rulings or legal interpretations, they stressed, poses a direct threat to the rule of law.

The experts also urged the Peruvian government to reinstate the judge or, at the very least, provide a clear and evidence-based justification for the decision. Without such transparency, they warned, the move risks being viewed as politically motivated. They further encouraged international observers and civil society organizations to closely monitor the situation.

Legal analysts say that this development could have broader implications for Peru’s judicial system. If judges fear repercussions for ruling against powerful interests, it could lead to self-censorship and compromise the fairness of future decisions. This, in turn, may impact not only domestic cases but also Peru’s standing in the international legal community.

The Peruvian government has yet to issue a detailed response to the UN experts’ concerns. However, officials have previously defended similar decisions as part of efforts to maintain accountability within the judiciary. Critics, on the other hand, argue that such measures often lack transparency and can be misused to exert influence over the courts.

Civil society groups in Peru have echoed the UN’s concerns, calling for reforms to strengthen judicial independence and protect judges from undue interference. Protests and public statements from legal organizations highlight growing unease among citizens about the direction of the country’s democratic institutions.
