Judge Again Axes MyPort’s Apple Suit Under Alice

A federal judge has dismissed a patent infringement suit brought by MyPort Technologies Inc. against Apple Inc., stating that the patents it was asserting described unpatentable abstract ideas.
The ruling, issued by the U.S. District Court for the District of Delaware, marks the latest development in the legal battle between the two tech giants.
MyPort Technologies Inc. had filed a lawsuit against Apple Inc., alleging infringement of several patents related to personal voice assistant technology, location services, multimedia capture, transmission, speech-to-text conversion, and more.
However, the court found that the patents in question described abstract ideas that were not eligible for patent protection under the Alice Corp. v. CLS Bank International Supreme Court decision.
The patents involved in the case included:
- 9,832,017 – Apparatus for personal voice assistant, location services, multimedia capture, transmission, speech to text conversion, photo/video image/object recognition, creation of searchable metatags/contextual tags, storage, and search retrieval.
- 10,237,067 – Apparatus for voice assistant, location tagging, multimedia capture, transmission, speech to text conversion, photo/video image/object recognition, creation of searchable metatags/contextual tags, storage, and search retrieval.
- 10,721,066 – Method for voice assistant, location tagging, multimedia capture, transmission, speech to text conversion, photo/video image/object recognition, creation of searchable metatags/contextual tags, storage, and search retrieval.
- 10,368,998 – Modular reverse shoulder orthopedic implant and method of implanting the same.
The court’s decision to dismiss the case is a setback for MyPort Technologies Inc., which will now need to reassess its legal strategy in light of this ruling.
Apple Inc. has not issued a public statement regarding the latest ruling in the case.
