SEC Lawyer Quits Amid Scandal Over Hidden Revoked Law License

Despite being required to maintain an active law license for the position, the employee concealed this fact on official forms and during the hiring process. The individual even falsely attested to being a member in good standing with the state bar, a claim that was eventually proven false.

Upon learning of the violation, the OIG opened a full investigation into the matter. The findings concluded that the attorney had violated federal ethics rules, misrepresented their qualifications, and undermined the agency’s credibility. Before disciplinary action could be completed, the employee resigned from the SEC.

The report also criticized the SEC’s internal controls, noting that the agency lacked effective mechanisms for verifying professional credentials, such as bar license status, both at the time of hiring and throughout employment. The OIG urged the SEC to strengthen its vetting procedures and establish regular checks to ensure that attorneys employed by the agency maintain active licenses and comply with professional requirements.

“This case underscores the importance of comprehensive background checks and ongoing credential monitoring,” the OIG wrote in its report. “Failure to do so compromises the mission of the agency and public trust in federal regulators.”

Legal and ethics experts say the incident is deeply troubling, particularly given the SEC’s role in enforcing financial and securities law. Attorneys at the SEC are responsible for investigating corporate misconduct, prosecuting securities fraud, and drafting enforcement actions — duties that require unimpeachable legal standing and professional ethics.

This isn’t just an HR lapse — it’s a red flag for the agency’s credibility. Tt also raises broader questions about how many federal agencies are auditing the professional status of employees in highly sensitive roles.
