New York’s IOLA Interest Surge Bolsters Civil Legal Aid for the Indigent

A Financial Boost Amidst a Changing Economic Landscape

The current uptick in interest rates has delivered a windfall for IOLA. During periods of high rates, the fund’s revenue has surpassed $100 million annually—a marked increase from the post-2008 low-interest era when disbursements were roughly half that amount. This steady inflow is crucial for grantee organizations, providing them with predictable funding for multi-year planning and sustained services.

Case in point: Brooklyn Legal Services Corporation A recently secured its largest-ever IOLA grant—$6.3 million over five years—enabling the expansion of eviction defense, domestic violence assistance, and support for small-business lease negotiations. Meanwhile, numerous regional legal service providers across New York continue to depend on IOLA for staffing, hotline operations, and legal clinics.

Ensuring Integrity and Focus Amid Legislative Pressure

In early 2024, Governor Hochul proposed sweeping $100 million from IOLA to the general fund, sparking vigorous opposition from legal industry groups. Four major bar associations intervened, highlighting that such use would violate the fund’s core purpose of supporting civil legal aid. In response, the governor withdrew the proposal, preserving IOLA’s mission and independence.

That same year, the Executive Budget eliminated plans to divert additional IOLA revenues—another win for stakeholders. The New York State Legislature, legal community, and judiciary acknowledged the dangers of diluting IOLA’s capacity to tackle eviction, foreclosure, benefits denials, and domestic violence.

Governance Strengthened for Future Stability

This June, Governor Hochul appointed six distinguished trustees to oversee IOLA’s operations, including chair Pei Pei Cheng de Castro and trustees with varied backgrounds in high-level legal practice. Their stewardship promises to guide the fund’s strategy and keep grantees well-resourced into the future.
