Federal Judges Bring Originalism Education Directly to Texas Law Students

These judicial-led educational efforts vary in format. In some cases, judges have been invited as guest lecturers in existing constitutional law courses. In others, they have organized independent seminars or even designed new elective courses dedicated entirely to originalism. These sessions often involve close readings of historical documents, such as the Federalist Papers, the writings of the Founding Fathers, and early court decisions, as well as discussions on how originalist reasoning applies to contemporary legal issues.

Reaction to the initiative has been mixed. Supporters, including many conservative legal scholars and students, applaud the effort as a much-needed correction to what they perceive as an ideological imbalance in legal education. They argue that students should be exposed to a wide range of interpretive theories and that originalism, as a philosophy increasingly adopted by federal judges, is especially relevant for anyone entering the legal profession. Critics, on the other hand, question whether it is appropriate for sitting judges to engage so directly in the education of law students, especially when their efforts may appear to promote a specific ideological agenda. Some faculty members have expressed concerns about the potential for such involvement to influence academic freedom or to politicize the classroom.

Despite these criticisms, the judges involved insist that their goal is not to indoctrinate students but to encourage rigorous debate and critical thinking. They argue that understanding originalism is essential not only for those who support the philosophy but also for those who wish to engage with or critique it effectively. By presenting originalism as a serious and intellectually grounded method of interpretation, they hope to foster a deeper and more nuanced understanding of constitutional law.
